Terms of Service

1. Who we are and what this is

PokeFeed ("PokeFeed", "we", "us", "our") is a community-driven, fan-made website for competitive Pokémon Champions teams, where users can publish, share, and vote on team compositions. PokeFeed is a personal, non-commercial project operated by Lorenzo Boffredo, based in Italy.

By accessing or using PokeFeed, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the site.

2. Eligibility

You must be at least 18 years old to create an account or use PokeFeed. By using the site, you confirm that you are 18 or older.

3. Your account

• You are responsible for keeping your account credentials secure and for all activity under your account.
• You must provide a valid email address and choose a username that does not impersonate others or violate these Terms.
• You may not create accounts through automated means, or maintain multiple accounts to abuse site features (such as voting). We use automated anti-bot measures (including a security check on signup and login) to enforce this.

4. User content and your responsibility

PokeFeed lets you publish content, including team titles, descriptions, rental codes, a display name, and a bio ("user content").

You are solely and entirely responsible for the content you submit. By submitting user content, you confirm that:

• it is yours to submit and does not infringe anyone else's rights;
• it does not contain unlawful, harmful, hateful, harassing, violent, sexual, defamatory, misleading, or otherwise objectionable material;
• it does not contain personal data of other people, spam, advertising, malware, or links intended to harm or deceive;
• it complies with all applicable laws.

User content does not represent PokeFeed. Opinions and content posted by users are theirs alone. We do not endorse, verify, or take responsibility for user content, and we are not liable for it to the fullest extent permitted by law.

We use automated moderation to help detect harmful content, but this does not mean we review, approve, or guarantee any user content. Automated moderation can miss things or flag things incorrectly.

5. Reporting illegal or harmful content

If you believe that content on PokeFeed is illegal, infringes your rights, or violates these Terms, you can report it to us at privacy@pokefeed.app. Please describe the content, where it appears, and why you believe it should be removed.

We will review reports and take appropriate action, which may include removing the content or taking no action if we determine the content does not violate these Terms or the law. Where appropriate, we will inform you of our decision.

This email address also serves as our point of contact for users and for any communication regarding these Terms or content on the site.

6. Our right to moderate and remove

We may, at our sole discretion and without prior notice:

• remove, hide, or refuse to publish any user content;
• suspend, restrict, or permanently delete any account;
• remove content that we believe violates these Terms or any law, or that we consider harmful or inappropriate.

We are not obligated to host, keep, or restore any content.

7. Acceptable use

You agree not to:

• use the site for any unlawful purpose;
• post content prohibited under Section 4;
• attempt to disrupt, overload, hack, or gain unauthorized access to the site or its systems;
• abuse, manipulate, or game site features (such as votes, saves, or copy counts);
• harass, threaten, or harm other users.

8. No scraping or unauthorized data extraction

You may not, without our prior written permission:

• scrape, crawl, harvest, copy, or systematically extract data, content, or the team database from PokeFeed by automated or manual means;
• reproduce, redistribute, resell, or reuse PokeFeed's content or data for commercial purposes;
• use PokeFeed's content or data to build or train a competing product or dataset.

PokeFeed's design, layout, original text, and the organization and compilation of its data are the result of significant effort and are protected accordingly.

9. Intellectual property and Pokémon trademark notice

PokeFeed is an unofficial, fan-made project. Pokémon and all related names, characters, and assets are trademarks and copyright of Nintendo, The Pokémon Company, Game Freak, and Creatures Inc. PokeFeed is not affiliated with, endorsed, sponsored, or approved by any of these entities.

Pokémon data and game information shown on the site are derived from publicly available community sources, credited on our licenses page. Sprites are provided by PokéAPI and remain the property of their respective owners.

You keep ownership of the user content you create. By publishing it on PokeFeed, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content on the site for the purpose of operating the service.

10. Disclaimer of warranties

PokeFeed is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted, error-free, secure, or that any content (including game data) is accurate, complete, or up to date.

11. Limitation of liability

To the fullest extent permitted by applicable law, PokeFeed and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from:

• your use of, or inability to use, the site;
• any user content or conduct of any user;
• any reliance on game data or information shown on the site.

Nothing in these Terms limits or excludes liability where it cannot be limited or excluded under applicable law (for example, liability for gross negligence or intent, or statutory consumer rights).

12. Changes to the service and these Terms

We may change, suspend, or discontinue the site (in whole or in part) at any time. We may also update these Terms from time to time; when we make material changes, we will update the "last updated" date. Continued use of the site after changes means you accept the updated Terms.

13. Termination

You may stop using PokeFeed at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion.

14. Governing law and disputes

These Terms are governed by the laws of Italy, and the courts of Italy shall have jurisdiction, except where mandatory consumer-protection laws of your country of residence provide otherwise. Nothing in this section deprives you of the mandatory legal protections available to you under the law of your country of residence.
